Use of links to the DESMASA website on third party pages does not necessarily imply collaboration with its owners, completely exonerating DESMASA from any responsibilities that might be derived from content published on these pages.
Guaranteeing confidentiality for technical and process data provided by the users through the lines specified in the website, it is just as important for DESMASA to guarantee user privacy, so unless explicitly rejected, it commits to:

Using it responsibly and solely for actions within its joint work with the user.

Within the framework of this confidentiality, the user will assume that, as a result of the joint work with DESMASA and the specific activity that it performs, the technical information provided might lead to the design and manufacturing of a machine that will be owned by the user, but whose intellectual and industrial property will belong to DESMASA, unless agreed otherwise.

Access and use conditions
Access to the DESMASA website is completely free of charge and suitable for all audiences. However, the possibility that personal data will be collected through the different lines of contact mentioned at the start of the legal notice gives us the legal and moral obligation to warn you that children aged under 14 years old cannot and should not provide any type of information to DESMASA unless expressly authorised by their legal guardian. As a final resort, DESMASA can decide whether to keep or delete the data provided, once the truthfulness of this authorisation has been confirmed and always within the framework of actions to encourage scientific vocations.
Provision of personal data, through any of the pertinent lines of contact and regardless of the user’s age, implies their express acceptance of the Privacy Policy that appears in section 2 of this document, enabling different tools to obtain explicit and informed consent required by the legislation in force.

DESMASA reserves the right to take relevant legal action against anyone violating these access and use conditions, where the user accepts that not initiating these actions does not mean that they have been formally renounced, remaining in force until the violations have been prescribed.
Any persons, physical or legal, who wish to create hyperlinks between their website and DESMASA’s website should follow and meet these requirements:
Prior authorisation will not be necessary, as long as the hyperlink only allows access to the home page and does not reproduce it at all. Any other form of hyperlink will require explicit and unequivocal authorisation from DESMASA.

Taking the previously compiled access and use conditions as a reference, the user acknowledges his or her exclusive responsibility for incorrect access and use of the website, exempting DESMASA from any direct or indirect consequence derived from it or that implies adverse economic, technical or legal actions from other users or third parties.

Purposes of data processing
Processing personal data collected through any of the lines of communication open with the user on their website (postal service, forms, emails, telephone or fax) has the purpose of:
Processing or managing requests for information and/or technical consultancy on the products sold by DESMASA.
Processing or managing requests for offers to purchase the products sold by DESMASA.
Sending information on DESMASA’s products that might be interesting for the user.
Processing and management of spontaneous applications for future recruitment processes.
Sending information on open recruitment processes that might be interesting for the user.
Processing and managing information relating to offers, products/services, company, etc. sent by possible suppliers.
At no point will a commercial profile be made for the user or automated decisions taken.
Data conservation time
The only personal data to be included in DESMASA’s records will be data for which, in the short, medium and long term, there is the possibility that:
The user or the entity where the user works is of commercial interest for DESMASA and becomes a customer.
The user or the entity where the user works is of commercial interest for DESMASA and becomes a supplier.
The user initiates a working or training relationship with DESMASA.
In the first two cases, the data will be kept indefinitely, unless:
DESMASA is no longer interested in the user’s entity as a customer/supplier;
The user’s contract with his/her entity ends;
The user expresses unequivocally in writing that they do not want their data to be processed by DESMASA. In these circumstances, the data will remain blocked and available to the Public Administration during the time established to meet the responsibilities emerging from the existing relationship.
In the last case (spontaneous job applications), the data will be kept for up to one year and if the candidate begins to work for DESMASA, the data will be kept for as long as the contract lasts and, in addition, the time set by the law to meet administrative, labour-related, tax-related and/or legal requirements.
Legitimisation for data processing
DESMASA is legitimised to process personal data as long as:

Any person has the right to obtain confirmation regarding whether DESMASA is processing personal data that affects them.
In the same way, he or she can exercise their right to access, rectification, limitation, portability, opposition and deletion, among other reasons, because it will be unnecessary for the purposes for which it was compiled. In this latter case, DESMASA will block it for the time strictly required to meet possible legal, taxation or labour-related claims, informing the user of these circumstances.
In addition, he or she will be able to revoke his or her consent in the event that it was given for a specific purpose, although able to modify his/her preferences at all times.
The user will be able to exercise his/her rights in writing, duly signed, using the info_web@desmasa.com email or the postal address: calle Condado de Treviño, 87 – 09001 – Burgos, identifying him/herself with his/her name, surname and ID card or passport number and stating the right they wish to exercise. A copy of their ID card/Passport should be attached to this written document and any other documentation that, in the user’s opinion, supports the request.
DESMASA informs the user that they can send any type of personal data protection claim to the Spanish Data Protection Agency, a Spanish state Control Authority.
Updating the Privacy Policy
This Policy has been updated in compliance with the requirements from the EU standard on protecting personal data, the General Data Protection Regulation (GDPR).
This could be modified without prior notice to adapt to legislative change, legal decisions and changes to jurisprudence or changes in DESMASA’s action and strategy. Consequently, the user should read this document each time they access the page.
